The idea of the spiritual basis of law in the works of Russian abroad philosophers (on the example of P. I. Novgodrotsev’s “philosophy of law” concept)
Annotation
This article presents an analysis of the concept of “philosophy of law” by the outstanding Russian legal scholar and philosopher Pavel Ivanovich Novgorodtsev (1866–1924). The paper analyzes the role of P. I. Novgorodtsev’s legal and philosophical research in the development of the domestic sphere of “philosophy of law”. The presented article also traces the life and creative path of Pavel Ivanovich. In the history of Russian thought, the name of Pavel Ivanovich Novgorodtsev will forever be associated with the beginning of the formation of the Russian philosophical and legal school. The author’s concept of law by P. I. Novgorodtsev was conditioned by the fundamental provisions of moral idealism and religious personalism. Based on the original concept of “philosophy of law”, P. I. Novgorodtsev developed the idea of the spiritual foundation of law, as well as the religious foundations of politics and public life. P. I. Novgorodtsev, building his unique philosophical and legal concept, assimilated the ideas of leading Russian idealists (B. Chicherin, V. Solovyov), and in turn influenced influential representatives of “Russian theology abroad” (Prot. G. Florovsky, Archpriest S. N. Bulgakov) and religious philosophy (I. Ilyin, B. Vysheslavtsev, N. Alekseev, S. Frank).
